These Terms of Use (“Terms”) govern your access to and use of FitMyBeauty and fitmybeauty.com. By accessing the website, creating an account, publishing a profile or listing, or using marketplace features, you agree to these Terms. If you do not agree, do not use the website.
Marketplace Role
FitMyBeauty provides an online marketplace where clients can discover and communicate with independent beauty professionals. FitMyBeauty is not a salon, employer, staffing agency, or representative of listed providers.
Beauty professionals independently determine their services, prices, availability, service locations, requirements, deposits, and appointment terms. Unless expressly stated otherwise, FitMyBeauty does not perform beauty services, schedule appointments, collect service payments, guarantee transactions, or supervise providers.
Eligibility
You must be at least 18 years old and legally capable of entering into an agreement to create an account or use marketplace communication features.
By using FitMyBeauty, you represent that the information you provide is accurate and that your use of the website complies with applicable laws.
User Accounts
You are responsible for:
- Providing accurate and current account information.
- Maintaining the confidentiality of your password.
- Preventing unauthorized access to your account.
- Promptly notifying FitMyBeauty of suspected unauthorized activity.
- All activity performed through your account, except where prohibited by law.
You may not create an account using another person’s identity or provide misleading information.
Beauty-Professional Responsibilities
Providers are solely responsible for ensuring that their profiles, listings, photographs, qualifications, experience, prices, availability, and service information are accurate and current.
Providers must:
- Hold any license, permit, certification, insurance, or authorization required in their jurisdiction.
- Clearly disclose pricing, deposits, cancellation terms, service locations, estimated durations, and client requirements.
- Perform services safely, professionally, and in compliance with applicable laws.
- Obtain appropriate permission before uploading photographs of clients or other individuals.
- Avoid misleading claims, stolen images, discriminatory practices, and prohibited services.
Publication or verification of a profile does not constitute a guarantee, endorsement, certification, or confirmation of every provider claim.
Client Responsibilities
Clients are responsible for reviewing provider profiles, service details, prices, requirements, availability, qualifications, and customer feedback before arranging a service.
Before proceeding, clients should confirm directly with the provider:
- Final pricing and any additional charges.
- Deposit and cancellation terms.
- Appointment date, time, and location.
- Required hair, products, materials, or preparation.
- The provider’s license or qualifications when applicable.
- Health, allergy, age, accessibility, and safety requirements.
Clients remain responsible for deciding whether a provider or service is appropriate for their needs.
Appointments, Payments, and Disputes
Any appointment, payment, deposit, cancellation, refund, or service arrangement made between a client and provider is an agreement between those parties.
Unless FitMyBeauty expressly introduces a payment or booking service governed by additional terms, FitMyBeauty is not a party to these arrangements and is not responsible for:
- Service quality or results.
- Missed, delayed, or cancelled appointments.
- Deposits, payments, refunds, or chargebacks.
- Injuries, allergic reactions, property damage, or other losses.
- Disagreements between clients and providers.
Users should document agreed service details and use safe, traceable payment methods.
Listings and Moderation
FitMyBeauty may review, approve, reject, edit, suspend, or remove profiles, listings, photographs, reviews, messages, or other content that violates these Terms, appears misleading, creates safety concerns, or may harm the marketplace.
Moderation does not transfer responsibility for user-submitted content to FitMyBeauty and does not guarantee that all inaccurate or inappropriate content will be identified.
Messages and Communications
Marketplace messaging must be used for legitimate service-related communication. Users must communicate respectfully and must not send spam, harassment, threats, unlawful content, or unsolicited advertising.
Do not send passwords, government identification numbers, payment-card information, banking credentials, or other highly sensitive information through marketplace messages.
Reviews
Reviews must reflect genuine experiences and must be truthful, relevant, and respectful. Users may not:
- Submit fabricated or manipulated reviews.
- Review their own services.
- Offer or accept compensation in exchange for misleading reviews.
- Use reviews to harass, threaten, discriminate, or disclose private information.
FitMyBeauty may remove reviews that violate these Terms or applicable law.
Prohibited Conduct
Users may not:
- Use FitMyBeauty for fraud, impersonation, exploitation, or unlawful activity.
- Publish false, deceptive, discriminatory, defamatory, or infringing content.
- Upload malware or interfere with website security or operation.
- Collect user information without authorization.
- Scrape, copy, reproduce, or commercially exploit website content without permission.
- Circumvent account restrictions or moderation decisions.
- Arrange or promote services that violate applicable law.
- Harass, threaten, or endanger another person.
- Misrepresent professional credentials, identity, location, prices, or availability.
Intellectual Property
FitMyBeauty’s name, logo, website design, original content, and platform materials are owned by or licensed to FitMyBeauty and may not be copied or used without authorization.
Users retain ownership of content they submit. By publishing content on FitMyBeauty, users grant FitMyBeauty a nonexclusive, worldwide, royalty-free license to host, display, reproduce, format, and distribute that content as necessary to operate and promote the marketplace.
Users represent that they have the rights and permissions needed to submit their content.
Account Suspension or Termination
FitMyBeauty may restrict, suspend, or terminate access when a user violates these Terms, creates safety or legal risk, abuses marketplace features, or engages in suspected fraud.
Users may request account deletion, subject to records that FitMyBeauty may retain for legal, security, fraud-prevention, or legitimate operational purposes.
Disclaimers
FitMyBeauty is provided on an “as is” and “as available” basis. To the extent permitted by law, FitMyBeauty makes no warranties regarding uninterrupted availability, error-free operation, provider suitability, service outcomes, listing accuracy, or user conduct.
Users interact with one another and arrange services at their own discretion and risk.
Limitation of Liability
To the maximum extent permitted by applicable law, FitMyBeauty and its owners, personnel, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, interactions between users, or services arranged through the marketplace.
Nothing in these Terms excludes liability that cannot legally be excluded.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold FitMyBeauty harmless from claims, losses, liabilities, damages, and expenses arising from your content, services, conduct, violation of these Terms, or infringement of another person’s rights.
Privacy
Your use of FitMyBeauty is also governed by the FitMyBeauty Privacy Policy.
Changes to These Terms
FitMyBeauty may update these Terms as the marketplace develops or legal requirements change. Updated Terms will be posted on this page with a revised effective date. Continued use after an update constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Before filing a legal claim, users are encouraged to contact FitMyBeauty to seek an informal resolution.
